1. Acceptance of Terms
By accessing this website (cruisingyachtelectrical.com) and booking a consultation or purchasing a service package or deliverable from Cruising Yacht Electrical (“we,” “us,” or “our”), you (“the Client”) agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not book or use our services.

2. Nature of Service (Remote Consulting & Design)
Unless a separate written agreement is entered into for a bespoke “Fly-In” On-Site Engineering engagement, Cruising Yacht Electrical provides remote technical consulting, fault-finding, and system design only:

  • We are not physically aboard your vessel performing manual electrical labor during remote consultations.
  • Depending on your experience level and service tier, we act either as your remote “Eyes and Brain” guiding your testing step-by-step over video, or as an overseeing technical partner assisting you with planning, design review, installation support, and commissioning.
  • Our advice, custom visual wiring diagrams, and Bills of Materials (BOMs) rely entirely on the accuracy of the measurements, cable run lengths, system specifications, photos, and live video information provided by you, the Client.

3. Client Responsibilities, Safety & Compliance

  • You Are the “Hands”: You acknowledge that you (or a local contractor you engage) are physically performing all inspection, testing, and installation work on the vessel. You are solely responsible for ensuring you have the physical capability, competent tool handling, and personal protective equipment to perform any task safely.
  • Safety First: Working with marine AC shore/inverter power and high-fault-current DC battery banks (including LiFePO4 lithium systems) carries inherent risks of electric shock, arc flash, burns, and fire. You agree to follow safe marine electrical protocols at all times (including isolating power sources prior to mechanical work, verifying isolation with a working multimeter, and using insulated tools). If you feel unsafe, unsure, or out of your depth at any point during a call or project, you agree to stop work immediately and seek local, physical hands-on assistance.
  • Standards & Local Regulatory Compliance: While our system designs and advice are informed by international marine standards – including ABYC (such as E-11 and E-13), AS/NZS 3004.2, and ISO 13297 – it remains your sole responsibility to ensure that any work performed on your vessel complies with the local laws, licensing rules (such as mandatory local sign-off for 120V/240V AC wiring), flag-state regulations, survey rules, and insurance requirements applicable to your vessel’s registration and location.

4. Custom Deliverables & Third-Party Suppliers

  • Custom Visual Wiring Diagrams: Where purchased as an add-on, a Small / Medium System Diagram ($250 AUD) includes the initial draft plus one (1) revision, and a Large / Full Lithium System Diagram ($450 AUD) includes the initial draft plus up to two (2) revisions. Minor adjustments within the original scope are covered by these revisions; however, if you substantially change your system architecture or core equipment selections after the initial draft is built, additional design time may be billed at our standard rate of $95 AUD per 30-minute block ($190 AUD/hr).
  • Custom Bills of Materials (BOM) & Supplier Links: When we provide a Custom BOM ($150 – $500 AUD) with direct click-to-buy links and supplier comparisons, we do so solely for your convenience. Cruising Yacht Electrical is not the manufacturer, distributor, or seller of any third-party hardware. We are not responsible or liable for supplier stock changes, price fluctuations after the BOM is issued, shipping or customs delays, marina layover costs, incorrect deliveries, or manufacturer hardware defects. All product warranties remain strictly between you and the relevant supplier or manufacturer.
  • Communication Scope: WhatsApp Business is provided strictly as a backup channel for booking administration or Google Meet connection drop-outs during a scheduled session – we do not provide free technical troubleshooting via WhatsApp. Email support between scheduled milestone calls is provided in accordance with your selected package tier (up to 2 quick check-in emails for Small Project Consults, up to 4 quick check-in emails for Medium Project Consults, and priority/unlimited email support during active Large Project / Full Refit Consults).

5. Payments, Credits, Cancellations & Refunds

  • Currency: All prices listed on our website and invoices are in Australian Dollars (AUD) and are paid upfront at the time of booking via Stripe.
  • 15-Minute Video Call ($55 AUD) & 100% Credit: The $55 AUD fee for an initial 15-Minute Video Call reserves your scheduled time slot. If you proceed to book a 1-Hour Diagnostic Video Call ($190 AUD) or any Project Consultation Package (Small at $350 AUD, Medium at $650 AUD, or Large at $1,100 AUD), your $55 AUD initial call fee is 100% credited toward the price of that service.
  • Rescheduling, Cancellations & No-Shows (24-Hour Policy):
    • More than 24 hours’ notice: You may reschedule any booked video session at no extra cost by giving more than 24 hours’ notice prior to the appointment start time.
    • Less than 24 hours’ notice or No-Show: If you cancel within 24 hours of a scheduled session or fail to attend (“no-show”), the fee for that session (or the corresponding time block from your Project Consultation Package) is forfeited to cover the reserved consulting slot. We understand that offshore passages and severe weather happen at sea – if an urgent maritime situation prevents you from attending, please message us as early as possible and we will always aim to be fair and reasonable.
  • Package Validity & Extra Time: Multi-call Project Consultation Packages remain valid for 12 months from the date of purchase unless extended by mutual written agreement. Additional live video call time beyond your package’s included hours can be added as needed at $95 AUD per 30-minute block ($190 AUD per hour).
  • Video Testimonial Rebates: Where a promotional rebate ($50 AUD or $100 AUD depending on package tier) is offered in exchange for a video testimonial, the rebate is refunded to your original payment method once the completed video is received following your consultation or project. By submitting a testimonial video, you grant Cruising Yacht Electrical permission to feature your video, first name, and vessel name on our website and social media pages.

6. Australian Consumer Law (ACL) & Limitation of Liability

  • Non-Excludable Statutory Guarantees: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the service. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
  • Inherent Limitations of Remote Consulting: Subject to your non-excludable rights under the Australian Consumer Law above, you acknowledge that remote diagnostics and design have inherent limitations compared to an in-person physical inspection. We cannot see hidden wiring behind bulkheads, detect unmeasured high-resistance connections, or verify the physical torque of terminals unless testable and visible via your camera and multimeter.
  • Limitation of Liability: To the maximum extent permitted by law (including Section 64A of the Australian Consumer Law where applicable), our total aggregate liability to you for any claim arising out of or relating to our services is capped at, at our option, the re-supply of the consulting services or the refund of the total fees actually paid by you to Cruising Yacht Electrical for the specific service giving rise to the claim. To the fullest extent permitted by law, Cruising Yacht Electrical shall not be liable for any indirect, incidental, special, or consequential loss, loss of charter revenue, vessel downtime, third-party contractor costs, physical damage to the vessel or equipment resulting from your implementation of our advice, or personal injury sustained while performing work on your vessel.

7. Intellectual Property
All custom visual wiring diagrams, Bills of Materials (BOMs), cable and fuse schedules, written diagnostic summaries, and digital guides provided to you remain the intellectual property of Cruising Yacht Electrical. Upon full payment, you are granted a non-exclusive license to use these materials solely for the maintenance, repair, and upgrade of your specific nominated vessel (or explicitly contracted vessels under a multi-vessel Charter Fleet agreement). They may not be resold, published online, or redistributed commercially without our prior written consent.

8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
