1. Acceptance of Terms By accessing this website and booking a consultation with Cruising Yacht Electrical, you (“the Client”) agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.
2. Nature of Service (Consulting Only) Cruising Yacht Electrical provides remote technical advice and diagnostics only.
We are not performing physical labor on your vessel.
Our services act as a guide to assist you in troubleshooting or planning electrical systems.
The service relies entirely on the accuracy of the information, photos, and video provided by you, the Client.
3. Client Responsibilities & Safety
You are the “Hands”: You acknowledge that you (or a contractor you hire) are physically performing the work. You are responsible for ensuring you have the physical ability and safety equipment to perform these tasks.
Safety First: You agree to follow standard marine safety protocols (e.g., disconnecting power sources, using insulated tools) at all times. If you feel unsafe or unsure at any point, you agree to stop immediately and seek local, physical assistance.
Local Compliance: It is your responsibility to ensure that any modifications made to your vessel comply with local laws, marine standards (e.g., ABYC, ISO, AS/NZS), and insurance requirements applicable to your vessel’s location and registration.
4. Limitation of Liability (Important) To the maximum extent permitted by applicable law, Cruising Yacht Electrical shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your use or inability to use the advice provided.
Any physical damage to the vessel or equipment resulting from the implementation of our advice.
Any personal injury sustained while performing tasks discussed during a consultation.
Our advice is provided “as is” and without warranty of any kind. While we exercise professional care and skill, remote diagnostics have inherent limitations compared to physical inspection.
5. Payments, Cancellations, and Refunds
Triage Retainer: The $55 Triage Fee is a non-refundable retainer for the consultant’s scheduled time and expertise. This fee secures your specific time slot and prevents others from booking it.
Cancellations & No-Shows:
Less than 24 hours notice: If you cancel within 24 hours of the appointment or fail to attend (“no-show”), the full $55 fee is forfeited to cover the lost booking opportunity.
More than 24 hours notice: If you cancel with more than 24 hours notice, you may reschedule the appointment at no extra cost.
Service Credit: If a 15-minute Triage Call results in a booking for a “Deep Dive” session or “Project Consultation,” the original $55 fee will be fully credited toward the cost of the new service.
ACL Rights: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
6. Intellectual Property Any custom wiring diagrams, project guides, or written reports provided to you are the intellectual property of Cruising Yacht Electrical. They are for your personal use on your specific vessel and may not be resold or redistributed.
7. Governing Law These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.
